What is the difference between adware and spyware?
Adware is any software application that is offered to consumers for free or for a reduced charge in exchange for the user's agreement to receive advertising. It is installed on user's computers after the user has been given notice, and then consents to the installation. In addition, adware maybe readily uninstalled. Spyware is a software application that is installed on the user's computer without notice and without the user's consent as well as a software application that is difficult or impossible to remove. Spyware often gathers information from a user's computer without the user's consent and reports the information to the creator of the software or one or more third parties. There is no overlap between adware and spyware. eXact's Software is adware. eXact uses best reasonable commercial efforts to ensure that all users receive adequate notice and give their consent before any of its software products are installed on users' computers.

What if I believe that the eXact Software was installed on my computer without notice and consent?
Adware is normally downloaded as part of a software bundle via the Internet and it generates revenue to support other software applications. For example, if you want a free game or a free toolbar, the providers of these software applications will only allow you to download these applications at no cost if they can generate revenue from advertising. eXact enters into distribution agreements with these third party software application partners. Our distribution agreements require that the distribution partners obtain the "informed consent" of users before any eXact Software is installed. Users must be given conspicuous notice that the eXact Software is being installed and must consent to eXact's End User License Agreement. eXact actively monitors the churn rate of eXact Software uninstalls to determine if any distribution partners are downloading its software without adequate notice and consent. In addition, eXact investigates all complaints regarding software being uninstalled without adequate notice and consent. In the event a distribution partner is installing the eXact Software without adequate notice and consent and does not correct the problem, eXact terminates its distribution agreement with that partner. If you believe that you were not given adequate notice and consent, please contact general@exactadvertising.com.
